Terms and Conditions

1. Introduction

1.1 These terms and conditions constitute a binding contract between customer (You/The Player/User) and ("Zamani Bets (Pty) LTD t/a SpotOnBets registration number 2010/001924/07 or "We/Our/Us/the Company") and govern your use of the gaming services offered by the Company (the "Services."). Opening an account and using the services, you agree to be bound by these terms and conditions.

1.2 We reserve the right to update these Terms from time to time in order to address legal and regulatory changes, to incorporate changes in our business or the Services offered, or to improve the clarity and helpfulness of these Terms. All changes made will be displayed on our website and it is the customer's responsibility to check our website from time to time to review any updated Terms when posted. The updated Terms shall govern and control once they are posted to our website. It is your responsibility to retain copies of transaction records and service policies and rules.

1.3 These Terms and Conditions shall govern any bets placed by You. These bets and all interactions between SpotOnBets and You will also be governed by applicable requirements of the national legislation of South Africa, the Western Cape Gambling and Racing Act and their current Regulations and Rules and The Financial Intelligence Centre Act, 38 of 2001, and any other legislation that maybe applicable.

1.4 The Company is licensed, regulated and accredited by the Western Cape Gambling and Racing Board - License Number: 10185786

2. Legal Requirements

2.1 Our service is restricted to individuals of legal age (18+). We can only accept bets placed within the borders of the Republic of South Africa. Bets placed from outside the borders of South Africa and regions where sports betting is not prohibited by law will not be accepted and will be voided should they appear on our site.

2.2 While having an active account, it is your responsibility, to make sure you do not infringe on any laws within your jurisdiction, while conducting business with Us.

2.3 You acknowledge

2.4 Consent and agree that you make use of the services at your own risk and assume all responsibility for your use of such services. Except where expressly provided otherwise, the website, all content provided on or through our website, and Our service are provided "as is".

2.5 Furthermore, you agree that use of our service is for your own personal entertainment and non-professional use and, in doing so, are acting on your own behalf and acknowledge that any activities in violation of these Terms and Conditions are strictly prohibited.

2.6 By opening an account or using our Services, you represent, warrant and agree that you will comply with all laws, statutes and regulations in relation to your use of our service. We are not responsible for any illegal or unauthorized use of our service. By accepting these Terms and Conditions, you agree to assist us with the compliance to applicable laws and regulations.

2.7 Any interaction or behaviour by the customer that has been deemed inappropriate or abusive will not be tolerated and will result in account closure.

2.8 We may, at our sole discretion and without incurring liability of any kind, at any time suspend our service in whole or in part.

2.9 If a dispute arises between a Customer and us in relation to the liability to pay alleged winnings to the Customer, and that dispute cannot be resolved between the parties, the dispute may be referred to the Western Cape Gambling and Racing Board ("the Board") for resolution.

2.10 The Customer acknowledges that we are not a financial institution or a currency exchange bureau and shall not use Us as an intermediary to transfer funds, used or unused with or without ill intentions.

3. Licensing

3.1 Zamani Bets (Pty) Ltd registered number: 2010/001924/07 is a private company which is governed by the laws of South Africa and the prescribed operation rules for bookmakers in the Western Cape and South Africa. Zamani Bets holds a registered premise at Unit 005 ground A, 200 on main, corner of main street and Bowwood road, Claremont, Western Cape, 7708.

3.2 Zamani Bets (Pty) Ltd is a licenced bookmaker trading as SpotOnBets. SpotOnBets is licensed by the Western Cape Gambling and Racing Board under bookmaker license number 10185786.

4. Eligibility to bet

4.1 No person may apply for an account or place a bet with Us or claim any winnings unless that person:

4.1.1 Is a natural person (companies, close corporations and other corporate entities are disqualified from betting) with full capacity to contract;

4.1.2 Is 18 years of age or older, and we reserve the right to request proof of age;

4.1.3 Has completed, in full, a Player Account registration form and fulfilled any regulatory requirements, inclusive of requirements set out in the Financial Intelligence Centre Act 38 of 2001 (“FICA”) and the Protection of Personal Information Act 4 of 2013 (“POPIA”) (with specific reference to the provisions relating to the processing of personal information in general at Sections 8 - 25, prior authorisation at Sections 56 - 58, code of conduct at Sections 59 -67, trans border information flows at Section 72; and applicable penalties at Sections 71 -105) Legislation, and been accepted as a Customer by SpotOnBets;

4.1.4 Is not an excluded person in terms of Our responsible gambling programme or is not listed as an excluded person by the Western Cape Gambling and Racing Board or is not listed as an excluded person in the national register of excluded persons referred to in section 14 of the National Gambling Act, 2004, and

4.1.5 Is not in breach of these Terms and Conditions.

5. Application for registering an opening account

5.1 Should you want to open an account with us, you will be required to complete the customer registration process in full without omitting any information. We reserve the rights to amend the customer registration form at any given time.

5.2 By registering an account, you represent and warrant that you are at least 18 years old, are competent to enter into a binding legal agreement, and that you hereby understand and accept all the Terms and Conditions.

5.3 The customer warrants that all information disclosed during the registration process with Us, is and shall remain true and correct during the time of registration and the duration of a customer holding a valid and active account with Us.

5.4 Should any details change regarding:

5.4.1 Your customer profile; and/or

5.4.2 Your eligibility to bet; and/or

5.4.3 Your legal status or legal capacity; and/or

5.4.4 Any other matter that may reasonably be expected to have a negative; and/or

5.4.5 Impact on your capacity or ability to manage your Player Account

You are obligated to promptly notify Us via written communication from such change.

5.5 Customers are restricted to opening one account

5.5.1 You may only register and operate a single account with a single bank account. If you hold more than one account with the same bank account we reserve the right to suspend duplicate accounts.

5.6 We reserve the right to reject any application for a new account for whatever reason. Various reasons for rejecting an application for a new account can be due to the following:

5.6.1 The Customer already has a SpotOnBets account; and/or

5.6.2 The customer registration form has not been completed in full; and/or

5.6.3 The information presented in the customer registration form is incorrect; and/or

5.6.4 A material omission in the provided details on the customer registration form; and/or

5.6.5 A client has self-excluded from gambling activities and/or

5.6.6 FICA non-compliant.

5.7 By registering an account, you also agree and consent that your Personal Information may be subject to cross border data transfer; where necessary and applicable for the performance of Our services to which these Terms and Conditions relate, in which case We undertake to comply fully with the provisions of POPIA and any other applicable Data Protection laws, including the General Data Protection Regulations to the extent that same is applicable.

6. Security

6.1 The safekeeping and proper use of all customer SpotOnBets account details and other information is solely the responsibility of the client. Sensitive information such as account number, username and passwords should be safeguarded always.

6.2 All accepted transactions where your username and password have been entered correctly and have been approved by Us will be deemed to have been placed and instigated by you.

6.3 Should any customer give away, share or lose his/her account number and/or password, we will not be held liable for any claims that may result from, or regarding that account. Customers are solely responsible for their account transactions and should keep their account information strictly confidential.

6.4 The Customer undertakes to notify Us immediately if the Customer's account information is lost, stolen, misappropriated, or utilised by someone other than the Customer or the Customer has reason to believe that any of these circumstances has occurred, as well as change the Customer's security details immediately.

7. Account rules

7.1 We will treat all client information as well as betting and winnings confidential and comply fully with the provisions of POPIA

7.2 All betting transactions and customer information is strictly private and shall not be made known to a third party, unless:

7.2.1 An officer or an inspector appointed in terms of any applicable legislation requires such information;

7.2.2 A police official as defined in section 1 of the Criminal Procedure Act, 1977 (Act 51 of 1977) requires such information;

7.2.3 A person specially authorised thereto in terms of any legislation;

7.2.4 Pursuant to the terms of an order of a competent court compelling such disclosure;

7.2.5 Pursuant to the provisions of the POPIA; and

7.2.6 With the consent of the Customer.

7.3 By accepting the Terms:

7.3.1 We reserve the right to store all customer information, betting transaction and financial records. This will be done for the duration required by legislation or period deemed fit by Us.

7.3.2 All customers' personal information will be respected by Us will put in place all the necessary measurements in order to safeguard all customer information. We acquits ourselves from any liabilities or loss of data, by itself and other contracted service providers which are providing services to the end customer in partnership with Us.

7.4 We comply with the POPIA in terms of disclosure of customer information and communications. The POPIA may be downloaded from https://popia.co.za. If the Customer makes use of any feature which allows the Customer to upload material, information, comments, postings or other content to the mobile service, Website and any other media or electronic platform (collectively "the User Content"), the User Content will be treated as non-confidential information, and the Customer irrevocably agrees that We shall have the right to use, copy, distribute and disclose any User Content to third parties for any purpose.

7.5 We also have the right to disclose the Customer's identity to any third party who may claim that any User Content posted or uploaded by the Customer as aforesaid, constitutes a violation of their intellectual property rights or of their right to privacy. We shall have the right to remove, amend or edit any User Content made by the Customer on the Mobile service, Website and all other media or electronic platform.

8. Account rules

8.1 We and the SpotOnBets betting system calculate the balance of all customer accounts, this includes current balance, available funds, pending funds, bonus, bonus pay-outs as well as winning amounts.

8.2 An individual is not permitted to hold more than one account with Us.

8.3 All accounts should be for an individual's private use and not for the use or act on behalf of third parties.

8.4 You are not permitted to register, hold or use a SpotOnBets account on behalf of someone else.

8.5 Customers are not permitted to use Our platform for criminal or fraudulent behaviour, transactions or activities.

8.6 We do not permit for the use of computer software or electronic devices to try and gain an unfair advantage.

8.7 We reserve the right to not be associated with any:-

8.7.1 Customers who are employed by any sport's governing body or affiliate, that has direct influence with the body, are not permitted to use Our services; and/or

8.7.2 Natural person who has registered for exclusion from Gambling activities as per the Gambling Act 2004 section 14. Such will be prohibited from opening an account Us, and We will not be held responsible, or be held liable for any misleading actions used to open an account with Us by an excluded person.

8.8 Notwithstanding the aforementioned, the customer shall be deemed to be in default if:

8.8.1 Customer dies; and/or

8.8.2 The customer initiates the "opt out" process on Our Website; and/or

8.8.3 Customer commits any act of insolvency; and/or

8.8.4 The estate of the Customer is sequestrated; and/or

8.8.5 A customer endeavours to restructure their obligations with his/her creditors; and/or

8.8.6 Customer's name appears on or is placed on the register of excluded persons contemplated in section 14 of the National Gambling Act, 2004.

9. Closure or Suspension of account

9.1 We reserve the right prior to accepting any bets or transaction suspend betting services or close a customer account.

9.2 The customer will be required to notify Us in writing if they wish to close or suspend their account.

9.3 Upon closure of your customer account, We will refund the balance of customer account if no FICA, WCGRB and South African Laws or regulations restrict Us from doing so. The refund to the customer will only occur, after all, funds have been cleared as well as all adjustment for losses, winnings, bonuses and taxes have been made.

9.4 Upon closure of the account, should the customer have any outstanding monies to Us they are required to settle this account immediately.

9.5 After a closure or during the suspension of your account, no betting services will be accepted from the client involved, until the account is no longer suspended or opened.

9.6 We shall be entitled to close or suspend a customer account in the event or suspicion that the following has or will likely occur:

9.6.1 The customer has or attempted to partake in fraudulent or illegal actives whilst using Our product; and/or

9.6.2 Breach any of Our terms and conditions; and/or

9.6.3 Is found to have multiple accounts with Us; and/or

9.6.4 Is associated with any betting syndicates; and/or

9.6.5 Has or attempted to cheat or take advantage of SpotOnBets or its betting products.

9.7 Furthermore, We reserve Our right to freeze all accounts which We, in our sole discretion, believe or have reason to believe is suspicious pending an investigation by the relevant authorities, i.e. SARS and/or FIC investigators, and personal verification by Us or our appointed agents.

9.9 You acknowledge that we have no obligation whatsoever to provide you with prior notice of our decision to refuse, de-register, exclude or suspend you as a customer, nor are we required to furnish you with any reasons for such decisions.

10. FICA

10.1 Where FICA or its associated regulations and instruments specify such procedures and/or limits then We will be operated in accordance with such procedures and/or limits. Where FICA does not specify such aforementioned procedures and/or limits then We shall implement our own procedures and/or limits (subject always to any applicable legislation and/or regulations) in accordance with good corporate governance and the promotion of socially responsible gambling. Zamani Bets (Pty) Ltd (registration number 2010/001924/07) trading as SPOTONBETS reserves the right to suspend any account that has not met FICA requirements.

10.2 Types of FICA documents required.

•  Copy of ID document (SA Citizens) / Passport (Foreign Nationals); and

•  Proof of residential address less than three (3) months old (for example utility bill, store account statement, bank document with residential address, DSTV account, municipal letter).

10.3 The Customer can upload their FICA document through the spotonbets website. In order for The Customer to complete the document upload process The customer must visit www.spotonbets.co.za click the accounts menu and select upload documents.

10.4 The verification of The Customers FICA documents may take up 72 hours and only on Monday – Friday.

11. Contingencies which betting is offered

11.1 It is Our sole discretion to choose their offering in terms of markets, events, betting options, odds, limits and accepts or refuse any bets. This offering is not guaranteed and can change without prior notice.

11.2 We reserve the right to suspend an event or market at any time. During suspension, no bets will be accepted on the suspended market or event.

11.3 During live betting there will be a delay during placing of all in running bets, the duration of this delay varies depending on the specific sport, event or market the bet is being placed on. If the odds change or line moves during the delay, this will prevent the bet from being accepted by Us.

14. Placing and resulting of bets

14.1 You agree to pay us for all bets that are placed through the Service using your account.

14.2 We reserve the right to refuse or limit any bets at our sole discretion for any reason whatsoever. In circumstances where a bet is deemed to be or is declared void by us solely at our discretion (e.g. not as a result of any breach of these Terms), any sum deducted from your account with respect to that bet shall be credited to your account.

14.3 Bets shall only be valid if accepted by our server and subject to these Terms and Conditions. Until acceptance, no communications from you shall be binding on us and all information displayed on this site constitutes an invitation to play only. Should we determine to waive a rule in the interest of fair play to you, it shall only be for that instant and shall not set a precedent for the future.

14.4 By placing a bet, you represent and warrant that you are not prohibited from entering into the bet by any contract, regulation, rule, or sports governing body and that you do not know the outcome of the event upon which you are betting. In the event that these representations are false, then your bet is automatically void.

14.5 Without limiting our discretion to refuse or limit bets at our discretion, you agree that we may void any bets in our absolute discretion if:

14.5.1 We suspect you have engaged in any illegal activity or any prohibited activity (as defined below);and/or

14.5.2 You have breached any of these Terms and Conditions; and/or

14.5.3 There is a technological error related to the Service or the placing of your bet; and/or

14.5.4 We have reason to believe that your bet, or the event upon which you have bet, may be subject to manipulation, collusion, match-fixing, or other unethical activity; or where we are required to do so by law or regulation.

14.6 The official result is final for settlement purposes except where specific rules state the contrary. The podium position in Grand Prix racing, the medal ceremony in athletics and any similar official ceremony or presentation in other sports are to be treated as the official result.

14.7 In the absence of an official source, or when significant conflicting evidence is present, bets will be settled based on our own statistics.

14.8 Irrespective of which betting odds format you select for odds to be shown in your Customer account, all bets will be settled based on Decimal odds.

14.9 If any match is abandoned due to injury, bad weather, crowd trouble etc. all bets that have already been settled up until the time of abandonment will stand.

15. Payment by customer

15.1 All account transactions are performed in South African Rand.

15.2 Verification of banking details will be done if you use a credit, debit card, financial or bank account for your SpotOnBets transactions. All names on bank cards or financial accounts must match the name on the registered SpotOnBets account. If We find that your registration details does not match the bank/deposit details, We will reserve the right to immediately suspend your account.

15.3 Deposits made in incorrect names will be refunded if no law or regulation prevents Us from doing so. All bets placed using these funds could be void based on Our discretion.

15.4 Customers may make or authorise credit card or cash deposit into their customer account at any time.

15.5 Any monies held in your SpotOnBets account, will not accumulate interest.

15.6 We will not allow the transfer of funds between various customer accounts.

15.7 All card and instant EFT transactions for SpotOnBets will be processed through the FNB eCommerce switch and Callpay. At no stage do We store any card information on the Website.

15.8 All deposits will first settle any amounts outstanding to Us, before crediting the remaining monies to the customer account.

15.9 We require customers to deposit money with the intention to bet, any funds deposited for any reasons will be refunded, but on the condition, that We reserve the right to charge an administration fee. We will also be required to notify all relevant authorities of any suspicious transactions.

15.10 All bet/transactions will be deducted from Your account. All winning or credit transaction will be added to Your account.

15.11 We reserve the right to request for additional information regarding credit cards or bank account used to deposit in your SpotOnBets customer account.

15.12 If deemed necessary by Us, we reserve the right to request verification of credit card or proof of banking.

15.13 The customer shall not utilise money obtained from ill-gotten means including, but not limited to, any amount that has been incorrectly credited to his betting account as a result of an incorrect deposit entry (whether done erroneously or deliberately and fraudulently), a prohibited betting transaction, an incorrect result or incorrect benefit which does not rightfully accrue to the customer. We shall be entitled to void any and all winning betting transactions where applicable and claim from the customers all amounts wagered on unsuccessful betting transactions.

16. Credit

16.1 We will not offer credit and all bets placed by a customer are required to be supported by sufficient funds in a customer account.

16.2 We reserve the right to void any bets which have been placed in error and have been accepted whilst the customer's account did not have sufficient funds.

17.Payments

17.1 General payments to customer.

17.1.1 The Customers' accounts will be credited by Us in respect to winnings as well as refunds accruing to the customer in retrospect of the wages placed on a regular basis. The Odds/ Prices which are displayed are used to settle bets at the time the wage is accepted by Us, however, this is subject to possible alterations of errors and where possible will be reflected on the transaction detail. Certain bets can be subject to the relevant run/deduction where applicable.

17.1.2 Where funds are deemed to be incorrectly credited to a customer account, it is the customer's responsibility to notify Us about the aforesaid error without delay. Any bets placed by you after the error shall be deemed as void by Us unless notified by the customer prior to the transaction. You are legally required to return all the misallocated funds to Us which are exempt from any deductions erroneously credited to their account even in the cases where the customer has withdrawals such funds from the account.

17.1.3 Online or mobile settlement and payments of bets will be made solemnly to the valid account holder and not made available to any third party no matter what the circumstance. There is no negotiating or transferring of customer's rights of settlement or payment.

17.1.4 We reserve the right to verify the identity of all account holders at any time and particularly on withdrawal of funds. We, at our sole discretion, may require a client withdrawing funds to affirm, by way of signed and notarised affidavit, that the bets recorded as taken on his/her name are, in fact, his/her bets and not bets for any third party.

17.1.5 When wagers are placed and have been authenticated by Us, the withdrawal will be paid out in South African Rands into a valid South African account in the name of the customer. We reserve the right to not be seen as liable, if it is not able to transfer any monies held by it to any account held by the customer in a foreign jurisdiction.

18. Electronic Transfer (EFT)

18.1 Where withdrawal requests are processed via EFT, it is the sole duty of the customer to ensure that the correct and valid information that has been supplied in any request for electronic transfer of funds form is correct. If the provided information by the customer has been deemed unfit through our sole discretion, the request shall be warranted as invalid. We reserve the right not to accept any liability for the payment of various amounts requested into any bank account which has insufficient or inaccurate information missing.

18.2 If We receive a complete accurate request for a withdrawal/pay-out Electronic Transfer of funds, We shall undergo the following processes:

18.2.1 An investigation and/or verification to determine and confirm that the value which is being requested, less all deductions and adjustments which may be incurred, is available to be transferred from the allocated Your account, into the valid nominated bank account by the customer for this purpose; and/or

18.2.2 In the event that the requested made by the customer is not reflected in their account, We reserve the right to decline the request at its sole discretion; and/or

18.2.3 In the event that the requested amount is available in their account, within 24 (twenty-four) hours of confirming the availability of the amount, the electronic transfer of the requested amount from their account of the Customer to the account nominated by the Customer will be made. In addition to the aforesaid and for the purposes of this Clause, We shall be deemed to have fully complied with its obligation to effect such transfer at the time of giving the instruction to its bankers to effect such transfer and the 24 (twenty-four) hour period contemplated in this Clause shall not include such further period as may elapse before the requested amount is deposited into the banking account nominated by the Customer for this purpose.

We, with immediate effect will lessen the balance held by the credit of Your account by the value which has been transferred. We reserve the right to not be deemed liable for any deferral of credit to a customer account, due to circumstances beyond our control.

EFT Cash Out: Subject to time delays as set out by the banking provider concerned. We cannot be held liable for time delays if this withdrawal method is used.

18.3 We reserve the right to:

18.3.1 Regardless of the nature of the dispute. The Customer, shall not be permitted to request Us to reverse any approved payment which has been instructed by The Customer on the Spotonbets website via the withdraw funds facility in the banking section.

18.4 We will not be responsible for the following:

18.4.1 Failures, malfunctions or delays which may occur, of various electronic transfers as well as alternative credit card/ debit card processing machine. This includes the auxiliary or distribution of networks which derive from circumstances beyond Our control or any damages, loss or expense which the Customer may suffer as a result thereof, and

18.4.2 Be liable for possible damages and losses incurred by the customer due to unauthorised access to any inaccurate information and data supplied through an electronic funds transfer unit as well as various credit card/ debit card processing mechanism.

19. General Withdrawal Policy

19.1 If a financial account and/or credit/debit card has been used to deposit funds, the name registered Our account must correspond to the name registered on the financial account/card. In the case of a request to pay funds via Bank Transfer, the acquiring bank account must be held in the same name used during registration.

19.2 Withdrawals may require multiple transactions over a number of days, based on payment provider limitations.

19.3 There may be charges incurred for withdrawals which you will be clearly informed of upon requesting your withdrawal.

19.4 We reserve the right to undertake reasonable diligence to verify the validity of any bets, wagers or winnings as a precondition to paying out any wins or permitting player withdrawals.

19.5 Due to Foreign Exchange regulations, We are required to pay out individuals who hold active bank accounts within South Africa and only in the currency of South African Rand

20. Identification Checks

20.1 Customers must provide a copy of their proof of identity and proof of address if not already provided when withdrawing funds from Us(proof of address should be less than 3 months old), Proof of identity must match the registered name and surname.

20.2 If any customer fails to provide the required documentation within 4 weeks of our request, the account may be subject to lock out and winnings and/or cash-ins made, voided. In cases of fraudulent documentation, accounts will be locked and all balances forfeited.

20.3 We reserve the right to request further due diligence documentation upon a customer making a withdrawal as We deem necessary.

20.4 The payment of a withdrawal will only be made to the customer who deposited the funds.

21. Review for Irregular Play

21.1 Before any withdrawals are processed, your play will be reviewed for any Prohibited Activity (defined below). Should we determine that Prohibited Activity has occurred, we reserve the right to withhold any withdrawals and/or confiscate all winnings which we reasonably believe are related to the Prohibited Activity.

21.2 Withdrawals requested when deposited funds have remained unused for betting transactions will be treated as Suspicious Transactions in accordance with FICA, and will be reported to the relevant authorities as such.

22. Adjustments

22.1 In the case of any error results or error credit, We reserve the right to adjust or make a correction on a customer's account balance.

22.2 Notwithstanding anything to the contrary herein contained, We shall be entitled to set-off any amount(s) due by the Customer against any funds standing to the credit of any of the customer's accounts with Us or to realize any security held by Us and to use the proceeds towards payment of any amount due by the Customer to Us

23. Chargebacks

23.1 If We incur any chargebacks, payment reversals or other charges in connection with your account, we reserve the right to recover such amounts from you.

23.2 You represent, warrant and undertake that no chargebacks or other payment reversals or cancellations shall be made concerning account without our prior written consent. In the event of any such chargeback, reversal or cancellation, you agree to indemnify and hold us harmless against any amounts, costs, claims, damages and expenses arising in connection with such chargebacks, reversals or cancellations, or in connection with our efforts to recover such sums from you.

24. Prohibited Activities

24.1 We reserve the right to monitor all customer activity for cheating, irregular play and bad faith. All such activity is expressly prohibited and may result in the immediate termination of your account. Without limitation, the following types of activities are expressly prohibited in connection with our site, Service ("Prohibited Activity"); or

24.1.1 The misuse or abuse of bugs, glitches or errors of the Service; or

24.1.2 The use of bots or any other form of artificial intelligence; or

24.1.3 Hacking, attacking or abusing the Service or any servers, software or other components of the Service; or

24.1.4 Using VPNs or other software to circumvent any geographic limitations applicable to the Service; or

24.1.5 The use of software to influence or modify the outcome of any of the games; or

24.1.6 Match-fixing, cheating or collusion; or

24.1.7 Participating in, aiding or facilitating criminal activity of any kind; or

24.1.8 Fraudulent or illegal activity of any kind; or

24.1.9 Abusive chargeback activity; or

24.1.10 Attempting to disrupt the Service or circumvent the technical measures employed by us to ensure the security and fair play of the Service; or

24.1.11 Any betting activity which we reasonably suspect to be irregular, unfair or in bad faith, including but not limited to equal, zero or low margin bets or hedge betting, or placing single bets equal to or in excess of 30% or more of the value of the bonus credited to their account until such time as the betting; or requirements for that bonus have been met.

24.1.12 We reserve the right to void any bets placed after the outcome of an event is known. Should a bet be placed with incorrect odds due to delayed ‘live' coverage of an event and where a team has gained a significant advantage as stated above, bets will be voided.

25. Breach

25.1 Breaching any of the stated terms and conditions by a customer will result in termination of the contractual relationship between the customer and Us, resulting in a closure of your account. We will notify a customer within reasonable time of your account being closed. After closure, all existing bets will be void.

25.2 The customer shall be liable for any legal expenses (including legal expenses on a client-attorney scale, collection charges and tracing fees) as well as any amount governmental tax including but not limited to value-added tax, which We may incur in recovering any amounts owing in respect of the Customer's account or a result of the Customer's breach of any of the conditions of use or the enforcement by Us of any of its rights against the customer.

26. Limitation of liability

26.1 We will not assume liability or responsibility for:

26.1.2 The accuracy of live score statistics, match tracker and results displayed during live games as well as immediately concluded events; and/or

26.1.3 Input, or transmission errors and reserves the right to rectify obvious errors; and/or

26.1.4 Using acts of Gods (Vis Major), amendment or repeal of legislation, fire, failure of telecommunications, explosion, strike, war, lock-out, flood, failure, theft and default of any computer hardware or software as well as any other equipment or similar cause beyond our reasonable control; and/or

26.1.6 We will not entertain any claims and to the greatest extent possible under all applicable laws, accept no liability for losses sustained by a customer's inability to access Our markets or website, due to malfunction, cancellation of accounts, inability to provide markets suspension of services or otherwise, regardless of the cause

If you disagree with the final decision of the Company in respect of your claim and/or dispute and would like to dispute it, then you may send your written submission along with the final decision of Spotonbets to the Western Cape Gambling and Racing Board. 32. Winnings

32.1 Your winnings are exclusive of the bet amount. Please note that for sportbetting, the maximum payout per single calendar day, across all sports and markets, is R 1,000,000,00.

32.2 The maximum payout per single bet is R 100,000,00.

32.3 All winnings will be credited to your User Account. If any funds are credited to your Player Account in error, Spotonbets reserves the right to remove such funds and void any transactions involving such funds, either at that time or retrospectively.

32.4 Payment of any taxes, fees, charges and levies that may apply to your winnings under any applicable laws shall be your sole responsibility

33.1 In order to place a sports bet the minimum wager amount is R 2.00

33.2 The maximum winnings limit (per day) for sports is the following:

33.2.1 The maximum winning amount for a single bet (1 sports selection in betslip) is R 100,000.00 across all sports bets.

33.2.2 The maximum winning amount for all multiple and or system bets (2 or more selections in betslip) is R 1,000,000.00 across all sports.

33.3 The maximum winnings limit (per day) for BetGames TV bets is R R100 000.00 across all BetGames TV games.

33.4 The maximum winnings amount (per day) on Spotonbets website is R 1 000 000.00.

33.5 A minimum bet of R2 at odds accumulative to 500 000/1 will match the maximum win limit (R 1 000 000,00), whereas, A minimum bet of R2 at odds in excess of 500 001/1 will exceed the maximum win limit (R 1 000 000,00), therefore the odds amount needs to correspond with the Maximum win limits in terms of the stake played.





Example 1:

R10 staked on a multiple bet with 20 legs in the ticket, Odds accumulative to 50 000/1. The bet will read – 500 000/R10. This is a valid bet.

Example 2:

R100 staked on a multiple bet with 20 Legs in the ticket, Odds accumulative to 50 000/1. The bet will read – 5 000 000/R10. This bet is in excess of the max win limit, therefore the bet will have to be adjusted to allow for the maximum win limit and bet to be valid.”
